1. Introduction

This Refund and Returns Policy applies to all services provided by R&R PROPERTIES NW LIMITED (Company No. 16569874), a property letting and management agency registered in England and Wales. Given the nature of residential lettings, this policy has been drafted in accordance with the Tenant Fees Act 2019, the Housing Act 1988 (as amended), and general principles of English contract law.

Please read this policy carefully before making any payment to us, including holding deposits, security deposits, or advance rent payments.

2. Holding Deposits

Where we accept a holding deposit to reserve a property on your behalf, the following terms apply:

• Maximum amount: The holding deposit will not exceed one week's rent, as required by the Tenant Fees Act 2019.
• Refund to tenant: If R&R PROPERTIES NW LIMITED or the landlord withdraws from the proposed tenancy for reasons not attributable to the tenant, the full holding deposit will be refunded to the tenant within 7 calendar days.
• Forfeiture – tenant at fault: The holding deposit will be retained (not refunded) if the tenant:
  • Provides false or misleading information during the referencing process;
  • Fails a Right to Rent check under the Immigration Act 2014;
  • Withdraws from the tenancy application after the referencing process has begun;
  • Fails to take reasonable steps to enter into a tenancy agreement within the deadline agreed in writing.
• The standard deadline for completing the tenancy agreement is 15 calendar days from receipt of the holding deposit, unless otherwise agreed in writing.

3. Security Deposits

All security deposits received by R&R PROPERTIES NW LIMITED are protected within a government-approved Tenancy Deposit Protection (TDP) scheme, in compliance with the Housing Act 2004 (as amended).

• The security deposit will be held for the duration of the tenancy to cover any legitimate deductions, including unpaid rent, damage beyond fair wear and tear, missing items, or cleaning costs.
• At the end of the tenancy, the deposit (or any undisputed portion thereof) will be returned to the tenant within 10 calendar days of both parties agreeing on the deductions.
• Any deductions will be documented and communicated in writing with supporting evidence (inventory check-out report, invoices, photographs).
• Disputed deductions will be referred to the independent adjudication service of the relevant TDP scheme.

4. Advance Rent Payments

Rent paid in advance pursuant to a signed Assured Shorthold Tenancy (AST) agreement is non-refundable, except in circumstances where:

• The tenancy is lawfully terminated by the landlord in breach of the agreement (e.g., unlawful eviction); or
• The property is rendered uninhabitable due to circumstances beyond the tenant's control, in which case a pro-rata refund may be considered.

All rent refund claims must be submitted in writing to management.rnr@hotmail.com and will be reviewed within 14 business days.

5. Management Fees

Fees charged to landlords for property management services are non-refundable once the relevant service has been performed. Where a management contract is terminated early by the landlord, any fees paid for services not yet rendered will be considered for a pro-rata refund at our discretion.

6. Disputes

Any dispute arising from or related to rental payments, deposits, or fees under this policy shall be governed by and construed in accordance with the laws of England and Wales. The parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.
